(7) บริษัท จ จำกัด ประกอบกิจการขายน้ำมันดิบและผลิตภัณฑ์น้ำมัน ได้ขายน้ำมันให้แก่บริษัท ฉ จำกัด โดยตกลงราคาน้ำมันเป็นหน่วยเงินตราต่างประเทศ บริษัท จ จำกัด ส่งมอบน้ำมันในวันพุธที่ 4 พฤษภาคม 2548 เป็นจำนวน 2 ครั้ง ครั้งแรกบริษัท จ จำกัด ส่งมอบน้ำมันเวลา 01.00 น. ซึ่งเป็นเวลาก่อนที่ธนาคารพาณิชย์จะประกาศอัตราแลกเปลี่ยนเงินตราในแต่ละวัน และเป็นเวลาก่อนที่ธนาคารแห่งประเทศไทยจะประกาศอัตราแลกเปลี่ยนเงินตราตามอัตราอ้างอิงประจำวันในแต่ละวัน (ธนาคารพาณิชย์จะประกาศอัตราแลกเปลี่ยนเงินตราในแต่ละวัน เริ่มต้นในเวลาประมาณ 08.00 น. ของแต่ละวัน ซึ่งอาจมีการประกาศอีกหลายครั้งในแต่ละวัน และธนาคารแห่งประเทศไทยจะประกาศอัตราแลกเปลี่ยนเงินตราตามอัตราอ้างอิงประจำวันในแต่ละวันในเวลาประมาณ 08.00 น. ของแต่ละวัน) และครั้งที่สองเวลา 08.30 น. ซึ่งเป็นเวลาภายหลังที่ธนาคารพาณิชย์ประกาศอัตราแลกเปลี่ยนเงินตราในแต่ละวัน และธนาคารแห่งประเทศไทยประกาศอัตราแลกเปลี่ยนเงินตราตามอัตราอ้างอิงประจำวันในแต่ละวันแล้ว บริษัท จ จำกัด มีสิทธิใช้อัตราแลกเปลี่ยนในการออกใบกำกับภาษี ดังนี้
(7/1) ใช้อัตราแลกเปลี่ยนเงินตรา (อัตราซื้อ) ของธนาคารพาณิชย์ที่ตั้งขึ้นตามกฎหมายว่าด้วยการธนาคารพาณิชย์ที่ได้ประกาศไว้ในการคำนวณเงินตราต่างประเทศเป็นเงินตราไทยในวันอังคารที่ 3 พฤษภาคม 2548 สำหรับการส่งมอบน้ำมันเวลา 01.00 น. และใช้อัตราแลกเปลี่ยนเงินตรา (อัตราซื้อ) ของธนาคารพาณิชย์ที่ได้ประกาศไว้ในการคำนวณเงินตราต่างประเทศเป็นเงินตราไทยในวันพุธที่ 4 พฤษภาคม 2548 สำหรับการส่งมอบน้ำมันเวลา 08.30 น. หรือ
(7/2) ใช้อัตราแลกเปลี่ยนเงินตราตามอัตราอ้างอิงประจำวัน (อัตราซื้อถัวเฉลี่ยซึ่งอาจจะเป็น SIGHT หรือ T/T ก็ได้) ที่ธนาคารแห่งประเทศไทยประกาศไว้ ณ วันอังคารที่ 3 พฤษภาคม 2548 ซึ่งเป็นอัตราแลกเปลี่ยนถัวเฉลี่ยของเงินสกุลต่างๆ ณ สิ้นวันทำการประจำวันจันทร์ที่ 2 พฤษภาคม 2548 สำหรับการส่งมอบน้ำมันเวลา 01.00 น. และใช้อัตราแลกเปลี่ยนเงินตราตามอัตราอ้างอิงประจำวัน (อัตราซื้อถัวเฉลี่ยซึ่งอาจจะเป็น SIGHT หรือ T/T ก็ได้) ที่ธนาคารแห่งประเทศไทยประกาศไว้ ณ วันพุธที่ 4 พฤษภาคม 2548 ซึ่งเป็นอัตราแลกเปลี่ยนถัวเฉลี่ยของเงินสกุลต่างๆ ณ สิ้นวันทำการประจำวันอังคารที่ 3 พฤษภาคม 2548 สำหรับการส่งมอบน้ำมันเวลา 08.30 น.
