4.4 พระราชบัญญัติป้องกันและปราบปรามการค้าประเวณี พ.ศ. 2539
พระราชบัญญัติป้องกันและปราบปรามการค้าประเวณี พ.ศ. 2539 (ราชกิจจานุเบกษา, 2539: 1 - 15) หลักสำคัญในการประกาศใช้พระราชบัญญัติฉบับนี้ คือ พระราชบัญญัติปรามการค้าประเวณี ฉบับเดิม (พ.ศ. 2503) ได้ประกาศใช้บังคับมาเป็นเวลานาน บทบัญญัติที่มีอยู่โดยเฉพาะอย่างยิ่งบทกำหนดโทษ ไม่เหมาะสมกับสถานการณ์ปัจจุบัน และโดยที่การค้าประเวณีมีสาเหตุสำคัญมาจากสภาพเศรษฐกิจและสังคม ผู้กระทำการค้าประเวณีส่วนมากเป็นผู้ซึ่งด้อยสติปัญญาและการศึกษา สมควรลดโทษผู้กระทำการค้าประเวณี และเปิดโอกาสให้บุคคลเหล่านั้นได้รับการคุ้มครองและพัฒนาอาชีพ ไม่ว่าจะเป็นการให้การอบรมฟื้นฟูจิตใจ การบำบัดรักษาโรค การฝึกอบรมและพัฒนาอาชีพตลอดจนพัฒนาคุณภาพชีวิต และในขณะเดียวกันเพื่อเป็นการปราบปรามการค้าประเวณีและเพื่อคุ้มครองบุคคลโดยเฉพาะเด็กและเยาวชนที่อาจถูกล่อลวงหรือชักพาไปเพื่อการค้าประเวณี สมควรกำหนดโทษบุคคลซึ่งกระทำชำเราโสเภณีเด็กในสถานบริการค้าประเวณี บุคคลซึ่งหารายได้จากการค้าประเวณีของเด็กและเยาวชน และบิดา มารดา หรือผู้ปกครอง ซึ่งมีส่วนร่วมรู้เห็นเป็นใจในการจัดหาผู้อยู่ในความปกครองไปเพื่อการค้าประเวณี กับให้อำนาจศาลที่จะถอนอำนาจปกครองของบิดา มารดา หรือผู้ปกครองของผู้กระทำความผิดซึ่งเป็นเด็ก เพราะเหตุที่มีส่วนร่วมรู้เห็นเป็นใจให้ผู้อยู่ในความปกครองกระทำการค้าประเวณี นอกจากนั้น ในปัจจุบันปรากฏว่าได้มีการโฆษณาชักชวนหรือแนะนำตัวทางสื่อมวลชนในลักษณะที่เห็นได้ว่าเป็นการเรียกร้องการติดต่อในการค้าประเวณีกันอย่างแพร่หลาย สมควรกำหนดให้การกระทำดังกล่าวเป็นความผิด โดยมีหน่วยงานหลักที่มีบทบาทหน้าที่ตามกฎหมาย ในการที่จะดำเนินการให้เป็นไปตามที่กฎหมายกำหนด คือ กระทรวงการพัฒนาสังคมและความมั่นคงของมนุษย์
สำหรับพระราชบัญญัติฉบับนี้ ได้มีการกำหนดบทลงโทษต่อการกระทำความผิดในฐานความผิดเกี่ยวกับการค้าประเวณี เมื่อเป็นการกระทำความผิดต่อเด็กและเยาวชน ได้เพิ่มบทลงโทษมากยิ่งขึ้น ยกตัวอย่างเช่น
มาตรา 8 ผู้ใดกระทำชำเราหรือกระทำอื่นใดเพื่อสำเร็จความใคร่ของตนเองหรือผู้อื่นแก่บุคคลอายุกว่าสิบห้าปีแต่ยังไม่เกินสิบแปดปีในสถานการค้าประเวณี โดยบุคคลนั้นจะยินยอมหรือไม่ก็ตาม ต้องระวางโทษจำคุกตั้งแต่หนึ่งปีถึงสามปีและปรับตั้งแต่สองหมื่นบาทถึงหกหมื่นบาท แต่ถ้าการกระทำความผิดตามวรรคหนึ่งเป็นการกระทำแก่เด็กอายุไม่เกินสิบห้าปี ต้องระวางโทษจำคุกตั้งแต่สองปีถึงหกปีและปรับตั้งแต่สี่หมื่นบาทถึงหนึ่งแสนสองหมื่นบาท เว้นแต่การกระทำตามวรรคหนึ่งเป็นการกระทำต่อคู่สมรสของตน โดยมิใช่เพื่อสำเร็จความใคร่ของผู้อื่น ผู้กระทำไม่มีความผิด
มาตรา 9 ผู้ใดเป็นธุระจัดหา ล่อไป หรือชักพาไปซึ่งบุคคลใดเพื่อให้บุคคลนั้น กระทำการค้าประเวณีแม้บุคคลนั้นจะยินยอมก็ตาม และไม่ว่าการกระทำต่าง ๆ อันประกอบเป็นความผิดนั้นจะได้กระทำภายในหรือนอกราชอาณาจักร ต้องระวางโทษจำคุกตั้งแต่หนึ่งปีถึง สิบปีและปรับตั้งแต่สองหมื่นบาทถึงสองแสนบาท แต่ถ้าการกระทำความผิดตามวรรคหนึ่ง เป็นการกระทำแก่บุคคลอายุกว่าสิบห้าปีแต่ยังไม่เกินสิบแปดปี ผู้กระทำต้องระวางโทษจำคุกตั้งแต่ห้าปีถึงสิบห้าปีและปรับตั้งแต่หนึ่งแสนบาทถึงสามแสนบาท ถ้าการกระทำความผิดตามวรรคหนึ่ง เป็นการกระทำแก่เด็กอายุยังไม่เกินสิบห้าปี ผู้กระทำต้องระวางโทษจำคุกตั้งแต่สิบปีถึงยี่สิบปีและปรับตั้งแต่สองแสนบาทถึงสี่แสนบาท และสำหรับการกระทำความผิดตาม วรรคหนึ่ง วรรคสอง หรือวรรคสาม เป็นการกระทำโดยใช้อุบายหลอกลวง ขู่เข็ญ ใช้กำลังประทุษร้าย ใช้อำนาจครอบงำผิดคลองธรรม หรือใช้วิธีข่มขืนใจด้วยประการใด ๆ ผู้กระทำต้องระวางโทษหนักกว่าที่บัญญัติไว้ในวรรคหนึ่ง วรรคสอง หรือวรรคสาม หนึ่งในสาม แล้วแต่กรณี
