2.3 พระราชบัญญัติการศึกษาภาคบังคับ พ.ศ.2545
พระราชบัญญัติการศึกษาภาคบังคับ พ.ศ.2545 (ราชกิจจานุเบกษา, 2545: 11 - 15) เป็นกฎหมายที่มีผลต่อการกำหนดการศึกษาที่เป็นภาคบังคบ โดยบัญญัติให้การศึกษาภาคบังคับเป็นจำนวน 9 ปี กล่าวคือ การศึกษาชั้นปีที่หนึ่งถึงชั้นปีที่เก้าของการศึกษาขั้นพื้นฐานตามกฎหมายว่าด้วยการศึกษาแห่งชาติ ซึ่งได้มีการกำหนดหน้าที่ของผู้ปกครอง หรือบุคคลอื่นที่เกี่ยวข้อง ในการส่งเสริมสนับสนุนให้เด็กได้เข้าเรียนตามกำหนดการศึกษาภาคบังคับ รวมไปถึงบทลงโทษ โดยมีสาระสำคัญ ดังนี้
มาตรา 6 ให้ผู้ปกครองส่งเด็กเข้าเรียนในสถานศึกษาเมื่อผู้ปกครองร้องขอ ให้สถานศึกษามีอำนาจผ่อนผันให้เด็กเข้าเรียนก่อนหรือหลังอายุตามเกณฑ์การศึกษาภาคบังคับได้ ทั้งนี้ ตามหลักเกณฑ์และวิธีการที่คณะกรรมการการศึกษาขั้นพื้นฐานกำหนด
มาตรา 11 ผู้ใดซึ่งมิใช่ผู้ปกครอง มีเด็กซึ่งไม่ได้เข้าเรียนในสถานศึกษาอาศัยอยู่ด้วย ต้องแจ้งสำนักงานเขตพื้นที่การศึกษา หรือองค์กรปกครองส่วนท้องถิ่น แล้วแต่กรณี ภายในหนึ่งเดือนนับแต่วันที่เด็กมาอาศัยอยู่ เว้นแต่ผู้ปกครองได้อาศัยอยู่ด้วยกับผู้นั้น
มาตรา 13 ผู้ปกครองที่ไม่ปฏิบัติตามมาตรา 6 ต้องระวางโทษปรับไม่เกินหนึ่งพันบาท
มาตรา 15 ผู้ใดโดยปราศจากเหตุอันสมควร กระทำด้วยประการใดๆ อันเป็นเหตุให้เด็กมิได้เรียนในสถานศึกษาตามพระราชบัญญัตินี้ ต้องระวางโทษปรับไม่เกินหนึ่งหมื่นบาท
