มาตรา 10 ผู้ใดเป็นบิดา มารดา หรือผู

มาตรา 10 ผู้ใดเป็นบิดา มารดา หรือผู้ปกครองของบุคคลซึ่งมีอายุยังไม่เกินสิบแปดปี รู้ว่ามีการกระทำความผิดตามมาตรา 9 ต่อผู้อยู่ในความปกครองของตน และมีส่วนร่วมรู้เห็นเป็นใจให้มีการกระทำความผิดนั้น ต้องระวางโทษจำคุกตั้งแต่สี่ปีถึงยี่สิบปีและปรับตั้งแต่แปดหมื่นบาทถึงสี่แสนบาท
มาตรา 11 ผู้ใดเป็นเจ้าของกิจการการค้าประเวณี ผู้ดูแล หรือผู้จัดการกิจการการค้าประเวณีหรือสถานการค้าประเวณี หรือเป็นผู้ควบคุมผู้กระทำกาค้าประเวณีในสถานการค้าประเวณี ต้องระวางโทษจำคุกตั้งแต่สามปีถึงสิบห้าปีและปรับตั้งแต่หกหมื่นบาทถึงสามแสนบาท ถ้ากิจการหรือสถานการค้าประเวณีตามวรรคหนึ่งมีบุคคลซึ่งมีอายุกว่าสิบห้าปี แต่ยังไม่เกินสิบแปดปีทำการค้าประเวณีอยู่ด้วย ผู้กระทำต้องระวางโทษจำคุกตั้งแต่ห้าปีถึงสิบห้าปีและปรับตั้งแต่หนึ่งแสนบาทถึงสามแสนบาท ถ้ากิจการหรือสถานการค้าประเวณีมีเด็กอายุยัง ไม่เกินสิบห้าปีทำการค้าประเวณีอยู่ด้วย ผู้กระทำต้องระวางโทษจำคุกตั้งแต่สิบปีถึงยี่สิบปีและปรับตั้งแต่สองแสนบาทถึงสี่แสนบาท ฯลฯ
นอกจากนี้ยังกำหนดให้มีคณะกรรมการคุ้มครองและพัฒนาอาชีพ เรียกโดยย่อว่า ก.ค.อ. ประกอบด้วย ปลัดกระทรวงการพัฒนาสังคมและความมั่นคงของมนุษย์ เป็นประธานกรรมการ มีอำนาจหน้าที่ ในการ (1) กำหนดนโยบายการคุ้มครองและพัฒนาอาชีพ รวมทั้งการพัฒนาคุณภาพชีวิตของผู้ค้าประเวณี (2) ประสานแผนงาน โครงการ ระบบงาน และกำหนดแนวทางปฏิบัติร่วมกันกับส่วนราชการและภาคเอกชนที่เกี่ยวข้องในการป้องกันและปราบปรามการค้าประเวณี (3) เสนอความเห็นต่อรัฐมนตรีเพื่อเสนอคณะรัฐมนตรีเกี่ยวกับการปรับปรุงการปฏิบัติราชการหรือแผนงานของส่วนราชการที่เกี่ยวข้องในเรื่องที่เกี่ยวกับการป้องกันและปราบปรามการค้าประเวณี (4) เสนอแนะรัฐมนตรีเกี่ยวกับการแต่งตั้งพนักงานเจ้าหน้าที่ และการจัดตั้งสถานแรกรับหรือสถานคุ้มครองและพัฒนาอาชีพของทางราชการ (5) เสนอแนะรัฐมนตรีเกี่ยวกับการจัดสรรงบประมาณเพื่อสนับสนุนการดำเนินการคุ้มครองและพัฒนาอาชีพ (6) เสนอแนะรัฐมนตรีเกี่ยวกับการกำหนดหลักเกณฑ์ วิธีการ และเงื่อนไขในการปฏิบัติตามมาตรา 26 (7) เสนอแนะรัฐมนตรีเกี่ยวกับการวางระเบียบ ข้อบังคับ หรือคำสั่งเกี่ยวกับการดำเนินงานของสถานแรกรับและสถานคุ้มครองและพัฒนาอาชีพ (8) วางระเบียบเกี่ยวกับการรับตัวและดูแลผู้ถูกควบคุมตามมาตรา 32 (9) วางระเบียบเกี่ยวกับหลักเกณฑ์และวิธีการส่งตัวบุคคลไปยังสถานแรกรับและสถานคุ้มครองและพัฒนาอาชีพ ตลอดจนการกำหนดระยะเวลาในการรับการคุ้มครอง และพัฒนาอาชีพในสถานคุ้มครองและพัฒนาอาชีพ
