ลูกจ้างสัญญาว่าจะไม่ประกอบธุรกิจ หรือทำงานให้กับบริษัทที่ประกอบธุรกิจประเภทเดียวกันกับนายจ้าง ในลักษณะที่นำทรัพย์สินทางปัญญาของนายจ้างไปใช้ ตลอดทั้งจะไม่กระทำการใด ๆ อันเป็นการแข่งขันกับธุรกิจของนายจ้าง เฉพาะที่อาศัยข้อมูลการค้าอันเป็นความลับทางการค้าของนายจ้าง ไม่ว่าทางตรงหรือทางอ้อม ตลอดจนไม่กระทำหรือช่วยเหลือ หรือยินยอมให้บุคคลใดกระทำการดังกล่าว ตลอดระยะเวลาของสัญญานี้ และภายในกำหนดระยะเวลา 1 ปี นับแต่วันที่สัญญานี้สิ้นสุดลง
