2. บทบัญญัติกฎหมายที่เกี่ยวข้องกับการ "พัฒนาและส่งเสริม" เด็กและเยาวชน
2.1 พระราชบัญญัติส่งเสริมการพัฒนาเด็กและเยาวชนแห่งชาติ พ.ศ. 2550
พระราชบัญญัติส่งเสริมการพัฒนาเด็กและเยาวชนแห่งชาติ พ.ศ. 2550 (ราชกิจจานุเบกษา, 2551: 1 – 15) นับเป็นกฎหมายที่มีเนื้อหาสาระใกล้เคียงกับอนุสัญญาว่าด้วยสิทธิเด็ก กล่าวคือ นอกจากบัญญัติที่เกี่ยวข้องกับสิทธิในการได้รับการพัฒนาแล้ว ยังมีการเพิ่มเติมเนื้อหาสาระที่สำคัญโดยเฉพาะเรื่องการสร้างการมีส่วนร่วมของเด็ก และเยาวชน มีการจัดตั้งสภาเด็กและเยาวชนแห่งประเทศไทย โดยมีกระทรวงการพัฒนาสังคมและความมั่นคงของมนุษย์เป็นผู้รักษาการตามมาตรา 6 ให้กระทรวงการพัฒนาสังคมและความมั่นคงของมนุษย์มีหน้าที่ในการพัฒนาเด็กและเยาวชน รวมทั้งแก้ไขปัญหาที่อาจมีผลกระทบในทางลบต่อเด็กและเยาวชน โดยมีหลักการดังต่อไปนี้ (1) การพัฒนาเด็กและเยาวชน การบังคับใช้และการปฏิบัติตามบทบัญญัติใด ๆ แห่งพระราชบัญญัตินี้ หรือกฎหมายอื่นที่เกี่ยวข้องกับเด็กและเยาวชน ต้องคำนึงถึงประโยชน์สูงสุดของเด็กและเยาวชนเป็นอันดับแรก (2) เด็กและเยาวชนทุกคนมีสิทธิในการได้รับการศึกษา และได้รับการศึกษาขั้นพื้นฐานที่มีคุณภาพสูงสุดตามที่กำหนดไว้ในรัฐธรรมนูญ (3) เด็กพิการ เด็กที่มีข้อจำกัดทางการเรียนรู้ และเด็กที่มีความสามารถพิเศษ มีสิทธิในการได้รับการศึกษาที่รัฐจัดให้เป็นพิเศษที่เหมาะสมกับลักษณะเด็กประเภทนั้น ๆ (4) เด็กและเยาวชนมีสิทธิในการรับบริการทางการสาธารณสุขที่ได้มาตรฐานสูงสุดเท่าที่มีการให้บริการทางด้านนี้ (5) เด็กและเยาวชนมีสิทธิในการเล่น มีเวลาพักผ่อน และเข้าร่วมกิจกรรมการละเล่นทางนันทนาการที่เหมาะสมตามวัยของเด็กและเยาวชน และการมีส่วนร่วมอย่างเสรีในทางวัฒนธรรมและศิลปะ
โดยการดำเนินการดังกล่าวข้างต้นให้กระทำโดยมีแนวทาง ดังต่อไปนี้ (1) ให้เด็กและเยาวชนมีความผูกพันต่อครอบครัว ภาคภูมิใจในความเป็นไทย มีวิถีชีวิตแบบประชาธิปไตย สามารถดำเนินชีวิตได้อย่างปลอดภัย และรู้จักเคารพสิทธิของผู้อื่น รวมทั้งกฎเกณฑ์และกติกาในสังคม (2) ให้มีสุขภาพและพลานามัยแข็งแรง รู้จักการป้องกันตนเองจากโรคและสิ่งเสพติด (3) ให้มีวุฒิภาวะทางอารมณ์ตามสมควรแก่วัย จริยธรรม และคุณธรรม (4) ให้มีทักษะและเจตคติที่ดีต่อการทำงาน มีศักดิ์ศรีและความภาคภูมิใจในการทำงานสุจริต (5) ให้รู้จักคิดอย่างมีเหตุผลและมุ่งมั่นพัฒนาตนเองอย่างต่อเนื่อง (6) ให้รู้จักช่วยเหลือผู้อื่นโดยมีจิตสำนึกในการให้และการอาสาสมัคร รวมทั้งมีส่วนร่วมในการพัฒนาชุมชนและประเทศชาติ (7) ให้มีความรับผิดชอบต่อตนเอง ต่อผู้อื่น และต่อส่วนรวมตามสมควรแก่วัย
มาตรา 7 ให้เด็กและเยาวชนทุกคนมีสิทธิได้รับการจดทะเบียนรับรองการเกิด การพัฒนาการยอมรับ การคุ้มครองและโอกาสในการมีส่วนร่วมตามที่บัญญัติในพระราชบัญญัตินี้ หรือกฎหมายอื่นที่เกี่ยวข้องอย่างเท่าเทียม โดยไม่มีการเลือกปฏิบัติโดยไม่เป็นธรรมเพราะเหตุแห่งความแตกต่างในเรื่องถิ่นกำเนิด เชื้อชาติ ภาษา เพศ อายุ ความพิการ สภาพทางกายหรือสุขภาพ สถานะของบุคคลฐานะทางเศรษฐกิจหรือสังคม ความเชื่อทางศาสนาและวัฒนธรรม การศึกษาอบรม ความคิดเห็นทางการเมือง การเกิดหรือสถานะอื่นของเด็กและเยาวชน บิดามารดา หรือผู้ปกครอง
มาตรา 8 ให้สำนักงานหรือสำนักงานพัฒนาสังคมและความมั่นคงของมนุษย์จังหวัดร่วมมือ ส่งเสริม และประสานงานกับองค์กรปกครองส่วนท้องถิ่นและหน่วยงานอื่นที่เกี่ยวข้องเพื่อจัดทำแผนพัฒนาเด็กและเยาวชนในระดับท้องถิ่นให้สอดคล้องกับแผนพัฒนาเด็กและเยาวชนแห่งชาติและให้องค์กรปกครองส่วนท้องถิ่นจัดสรรงบประมาณเพื่อการพัฒนาเด็กและเยาวชนที่อยู่ในพื้นที่รับผิดชอบ ในการจัดทำแผนพัฒนาเด็กและเยาวชนตามวรรคหนึ่ง ให้คำนึงถึงหลักการและแนวทางการมีส่วนร่วมของประชาชนและประชาสังคมในท้องถิ่นด้วย
