5.1 ค่าล่วงเวลา
5.1.1 ถ้าให้ลูกจ้างทำงานเกินเวลาทำงานปกติในวันทำงาน ลูกจ้างจะต้องได้รับค่าล่วงเวลาในอัตรา ดังนี้
ก. ไม่น้อยกว่าหนึ่งเท่าครึ่งของอัตราค่าจ้างต่อชั่วโมงในวันทำงานตามชั่วโมงที่ทำ หรือ
ข. ไม่น้อยกว่าหนึ่งเท่าครึ่งของอัตราค่าจ้างต่อหน่วยในวันทำงานตามจำนวนผลงานที่ทำได้สำหรับลูกจ้างซึ่งได้รับค่าจ้างตามผลงานโดยคำนวณเป็นหน่วย
