ไม่เป็นบุคคลต้องห้ามเข้าราชอาณาจักร ตาม พ.ร.บ.คนเข้าเมือง พ.ศ. 2522 เช่น เคยได้รับโทษจำคุกโดยคำพิพากษาของศาลไทยหรือคำพิพากษาของศาลต่างประเทศ มีพฤติการณ์เป็นที่น่าเชื่อว่าเป็นบุคคลที่เป็นภัยต่อสังคม หรือจะก่อเหตุร้ายให้เกิดอันตรายต่อความสงบสุขหรือความปลอดภัยของประชาชน หรือเป็นบุคคลซึ่งเจ้าหน้าที่รัฐบาลต่างประเทศได้ออกหมายจับ มีเงินค่าใช้จ่ายเพียงพอในขณะพำนักในไทยตามระเบียบกำหนดคืออย่างน้อยคนละ 20,000 บาท เป็นต้น
