เรื่อง กาแฟ

โดยที่เป็นการสมควรปรับปรุงประกาศกระทรวงสาธารณสุขว่าด้วยเรื่อง กาแฟ
อาศัยอำนาจตามความในมาตรา 5 และมาตรา 6(3)(4)(5)(6)(7) และ (10) แห่งพระราช บัญญัติอาหาร พ.ศ.2522 อันเป็นพระราชบัญญัติที่มีบทบัญญัติบางประการเกี่ยวกับการจำกัดสิทธิและ เสรีภาพของบุคคล ซึ่งมาตรา 29 ประกอบกับมาตรา 35 มาตรา 48 และมาตรา 50 ของรัฐธรรมนูญแห่ง ราชอาณาจักรไทยบัญญัติให้กระทำได้โดยอาศัยอำนาจตามบทบัญญัติแห่งกฎหมาย รัฐมนตรีว่าการกระทรวงสาธารณสุขออกประกาศไว้ ดังต่อไปนี้
ข้อ 1 ให้ยกเลิก
(1) ประกาศกระทรวงสาธารณสุข ฉบับที่ 77 (พ.ศ.2527) เรื่อง กาแฟ ลงวันที่
13 มกราคม พ.ศ.2527
(2) ประกาศกระทรวงสาธารณสุข ฉบับที่ 132 (พ.ศ.2533) เรื่อง กาแฟ (ฉบับที่ 2)
ลงวันที่ 15 ตุลาคม พ.ศ.2533
(3) ประกาศกระทรวงสาธารณสุข (ฉบับที่ 181) พ.ศ.2540 เรื่อง กาแฟ (ฉบับที่ 3)
ลงวันที่ 21 พฤศจิกายน พ.ศ.2540
ข้อ 2 ให้กาแฟที่คั่วแล้ว เป็นอาหารที่กำหนดคุณภาพหรือมาตรฐาน
ข้อ 3 กาแฟตามข้อ 2 แบ่งออกเป็น 6 ชนิด ดังต่อไปนี้
(1) กาแฟแท้ หมายความว่า ผลิตภัณฑ์ที่ได้จากผลที่แก่จัดของต้นกาแฟในสกุล
คอฟเฟีย (Coffea) ผ่านกรรมวิธีเอาเมล็ดออก นำเมล็ดมาคั่วจนได้ที่ และอาจบดให้ได้ขนาดตามความต้องการ
(2) กาแฟผสม หมายความว่า ผลิตภัณฑ์ที่ได้จากกาแฟตาม (1) ที่มีสิ่งอื่นที่ไม่เป็น
อันตรายต่อสุขภาพเป็นส่วนผสมอยู่ด้วย
(3) กาแฟที่สกัดกาเฟอีนออก หมายความว่า ผลิตภัณฑ์ที่ได้จากกาแฟตาม (1) ที่ได้
สกัดเอากาเฟอีนออก
(4) กาแฟสำเร็จรูป หมายความว่า ผลิตภัณฑ์ที่ได้จากผลที่แก่จัดของต้นกาแฟในสกุล
คอฟเฟียผ่านกรรมวิธีเอาเมล็ดออก นำเมล็ดมาคั่วจนได้ที่โดยมิได้มีการผสมสิ่งอื่นใด แล้วนำมาสกัดด้วยน้ำเท่านั้น นำไประเหยน้ำออกจนแห้งด้วยกรรมวิธีที่เหมาะสม มีลักษณะเป็นผง หรือเป็นเกล็ด หรือลักษณะ อื่น ๆ และสามารถละลายน้ำได้หมดทันที
(5) กาแฟสำเร็จรูปผสม หมายความว่า กาแฟสำเร็จรูปตาม (4) ที่มีสิ่งอื่นที่ไม่เป็น
อันตรายต่อสุขภาพเป็นส่วนผสมอยู่ด้วย
(6) กาแฟสำเร็จรูปที่สกัดกาเฟอีนออก หมายความว่า ผลิตภัณฑ์ที่ได้จากกาแฟตาม
(4) ที่ได้สกัดเอากาเฟอีนออก
ในกรณีที่นำกาแฟตาม (1)(2)(3)(4)(5) หรือ (6) มาปรุงแต่งรสในลักษณะพร้อมบริโภคและบรรจุในภาชนะปิดสนิทไม่ว่าผลิตภัณฑ์ดังกล่าวจะเป็นชนิดเหลวหรือแห้ง ให้ถือว่าเป็นกาแฟซึ่งต้องปฏิบัติตามประกาศฉบับนี้ด้วย
ข้อ 4 กาแฟแท้ต้องมีคุณภาพหรือมาตรฐาน ดังต่อไปนี้
(1) มีกลิ่นและรสของกาแฟแท้
(2) มีเถ้าทั้งหมดไม่เกินร้อยละ 6 ของน้ำหนัก และเถ้าทั้งหมดนั้นต้องละลายน้ำได้
ไม่น้อยกว่าร้อยละ 75 ของน้ำหนัก
(3) มีกาเฟอีนไม่น้อยกว่าร้อยละ 1 ของน้ำหนัก
(4) มีน้ำตาล คำนวณเป็นน้ำตาลอินเวิร์ตทั้งหมดได้ไม่เกินร้อยละ 1.5 ของน้ำหนัก
(5) ไม่ผสมวัตถุอื่นใด ยกเว้นวัตถุที่ไม่เป็นอันตรายต่อสุขภาพที่ใช้เพื่อการคั่วและ
แต่งกลิ่น
(6) ไม่ใช้สี เว้นแต่สีน้ำตาลเคี่ยวไหม้หรือสีคาราเมล
ข้อ 5 กาแฟผสมต้องมีคุณภาพหรือมาตรฐาน ดังต่อไปนี้
(1) มีกาแฟเป็นส่วนผสมไม่น้อยกว่าร้อยละ 20 ของน้ำหนักเมื่อแห้ง
(2) ใช้วัตถุที่ให้ความหวานแทนน้ำตาลได้ตามมาตรฐาน เอฟ เอ โอ/ดับบลิว เอช โอ,
โคเด็กซ์ (Joint FAO/WHO, Codex) ที่ว่าด้วยเรื่อง วัตถุเจือปนอาหาร และฉบับที่ได้แก้ไขเพิ่มเติม
ในกรณีที่ไม่มีมาตรฐานกำหนดไว้ตามวรรคหนึ่ง ให้สำนักงานคณะกรรมการอาหารและยาประกาศกำหนดโดยความเห็นชอบของคณะกรรมการอาหาร
(3) มีคุณภาพหรือมาตรฐานตามที่ได้รับความเห็นชอบจากสำนักงานคณะกรรมการ
อาหารและยา
ข้อ 6 กาแฟที่สกัดกาเฟอีนออก ต้องมีคุณภาพหรือมาตรฐาน ดังต่อไปนี้
(1) มีกาเฟอีนไม่เกินร้อยละ 0.1 ของน้ำหนัก
(2) มีคุณภาพหรือมาตรฐานตามที่ได้รับความเห็นชอบจากสำนักงานคณะกรรมการอาหารและยา
ข้อ 7 กาแฟสำเร็จรูป ต้องมีคุณภาพหรือมาตรฐาน ดังต่อไปนี้
(1) มีกลิ่นและรสของกาแฟแท้
(2) มีความชื้นไม่เกินร้อยละ 5 ของน้ำหนัก
(3) มีเถ้าทั้งหมดไม่น้อยกว่าร้อยละ 5 ของน้ำหนักเมื่อแห้ง
(4) มีกาเฟอีนไม่น้อยกว่าร้อยละ 2.5 ของน้ำหนัก
ข้อ 8 กาแฟสำเร็จรูปผสม ต้องมีคุณภาพหรือมาตรฐาน ดังต่อไปนี้
(1) มีความชื้นไม่เกินร้อยละ 5 ของน้ำหนัก
(2) มีกาเฟอีนไม่น้อยกว่าร้อยละ 1.5 ของน้ำหนัก
(3) ไม่ใช้สี เว้นแต่ สีน้ำตาลเคี่ยวไหม้ หรือสีคาราเมล
(4) ใช้วัตถุที่ให้ความหวานแทนน้ำตาลได้ตามมาตรฐาน เอฟ เอ โอ/ดับบลิว เอช โอ,
โคเด็กซ์ (Joint FAO/WHO, Codex) ที่ว่าด้วยเรื่อง วัตถุเจือปนอาหาร และฉบับที่ได้แก้ไขเพิ่มเติม
ในกรณีที่ไม่มีมาตรฐานกำหนดไว้ตามวรรคหนึ่ง ให้สำนักงานคณะกรรมการอาหารและยาประกาศกำหนดโดยความเห็นชอบของคณะกรรมการอาหาร
(5) มีคุณภาพหรือมาตรฐานตามที่ได้รับความเห็นชอบจากสำนักงานคณะกรรมการ
อาหารและยา
ข้อ 9 กาแฟสำเร็จรูปที่สกัดกาเฟอีนออก ต้องมีคุณภาพหรือมาตรฐาน ดังต่อไปนี้
(1) มีความชื้นไม่เกินร้อยละ 5 ของน้ำหนัก
(2) มีกาเฟอีนไม่เกินร้อยละ 0.3 ของน้ำหนัก
(3) มีคุณภาพหรือมาตรฐานตามที่ได้รับความเห็นชอบจากสำนักงานคณะกรรมการ
อาหารและยา
ข้อ 10 กาแฟตามวรรคสองของข้อ 3 ชนิดเหลว ต้องมีคุณภาพหรือมาตรฐาน ดังต่อไปนี้
(1) มีกลิ่นและรสตามลักษณะเฉพาะของกาแฟนั้น
(2) มีกาเฟอีนไม่เกิน 100 มิลลิกรัม ต่อกาแฟปรุงสำเร็จชนิดเหลว 100 มิลลิลิตร และ
กาเฟอีนดังกล่าวต้องมาจากกาแฟที่ใช้เป็นวัตถุดิบเท่านั้น
(3) ตรวจพบแบคทีเรียชนิดโคลิฟอร์ม น้อยกว่า 2.2 ต่อกาแฟ 100 มิลลิลิตร โดยวิธี
เอ็ม พี เอ็น (Most Probable Number)
(4) ตรวจไม่พบแบคทีเรียชนิด อี.โคไล (Escherichia coli)
(5) ไม่มีจุลินทรีย์ที่ทำให้เกิดโรค
(6) ไม่มีสารเป็นพิษจากจุลินทรีย์หรือสารเป็นพิษอื่นในปริมาณที่อาจเป็นอันตรายต่อสุขภาพ
(7) ไม่มียีสต์และเชื้อรา
(8) ใช้วัตถุที่ให้ความหวานแทนน้ำตาลได้ตามมาตรฐาน เอฟ เอ โอ/ดับบลิว เอช โอ,
โคเด็กซ์ (Joint FAO/WHO, Codex) ที่ว่าด้วยเรื่อง วัตถุเจือปนอาหาร และฉบับที่ได้แก้ไขเพิ่มเติม
ในกรณีที่ไม่มีมาตรฐานกำหนดไว้ตามวรรคหนึ่ง ให้สำนักงานคณะกรรมการอาหารและยาประกาศกำหนดโดยความเห็นชอบของคณะกรรมการอาหาร
(9) มีวัตถุกันเสียได้ ดังต่อไปนี้
(9.1) ซัลเฟอร์ไดออกไซด์ ไม่เกิน 70 มิลลิกรัม ต่อกาแฟปรุงสำเร็จ 1 กิโลกรัม
(9.2) กรดเบนโซอิค หรือกรดซอร์บิค หรือเกลือของกรดทั้งสองนี้ โดยคำนวณเป็นตัวกรดได้ไม่เกิน 200 มิลลิกรัม ต่อกาแฟปรุงสำเร็จ 1 กิโลกรัม
การใช้วัตถุกันเสียให้ใช้ได้เพียงชนิดหนึ่งชนิดใดตามปริมาณที่กำหนดใน (9.1) หรือ (9.2) ถ้าใช้เกินหนึ่งชนิด ต้องมีปริม
