เว้นแต่นายจ้างและลูกจ้างจะตกลงกันก่อนถึงกำหนดเกษียณอายุของลูกจ้างว่า ให้เปลี่ยนหรือเลื่อนกำหนดอายุของลูกจ้างออกไปอีกไม่เกินคราวละ 1 ปี จนกระทั่งลูกจ้างมีอายุครบ 60 ปี
