ถ้าผู้ขายไม่ทำประกันเพื่อให้มีผลต่อผู้เอาประกันและใช้บังคับได้ตลอดเวลาตามที่ได้อ่านไว้ในเงื่อนไขของสัญญาข้อ 6.11, 6.12.1, 6.12.2 หรือการประกันอื่นใดที่ผู้ขายต้องทำเพื่อให้มีผลต่อผู้เอาประกันภายใต้เงื่อนไขต่างๆตามสัญญาก็ดี ในกรณีเช่นนี้ผู้ซื้ออาจเข้าไปดำเนินการจัดทำประกันให้มีผลต่อผู้เอาประกันและใช้บังคับได้โดยที่ผู้ซื้อจะชำระค่าเบี้ยประกันหรือค่าธรรมเนียมต่างๆตามที่จำเป็นไปก่อนแล้วหักจากยอดเงินที่ถึงกำหนดจ่ายหรือเงินที่ผู้ซื้อพึงจะจ่ายให้ผู้ขาย เงินที่ผู้ซื้อชำระไปก่อนดังกล่าวให้ถือว่าเป็นหนี้ที่ผู้ขายต้องชดใช้ ทั้งนี้ผู้ซื้อจะคิดเงินเพิ่มอีกร้อยละ 10(สิบ) ของจำนวนเงินดังกล่าวเป็นค่าดำเนินการ
