The UTCA 1977 and UCCR 1999 are two statutory provisions which applied to consumer contracts. A term is considered as unfair "if it creates a significant imbalance in the parties' rights and obligations under the contract, to the detriment of the consumer, contrary to the requirement of good faith" as stipulated in the UTCCR 1999 s 5.
