๓.๓.๑ กรณีเอกสารผ่าน Notary Public

๓.๓.๑ กรณีเอกสารผ่าน Notary Public จะต้องดำเนินการเริ่มจากเอกสารใดๆ ที่ทำในต่างประเทศ ซึ่งผู้เสนอราคานำไปแสดงเป็นหลักฐานต่อทางราชการเพื่อประกอบการเสนอราคา การทำสัญญา การแก้ไขสัญญา การขยายเวลาทำการตามสัญญา การของดหรือค่าปรับ หรือการอื่นใด ผู้ที่ทำเอกสารหรือลงลายมือชื่อในเอกสารจะต้องเป็นผู้มีอำนาจในการลงลายมือชื่อในเอกสารในนนามของหน่วยงานหรือนิติบุคคล หรือโดยส่วนตัวแล้วแต่กรณี และเอกสารดังกล่าวจะต้องได้รับการตรวจสอบและรับรองจากเจ้าหน้าที่โดยลำดับดังนี้ คือ เจ้าหน้าที่ Notary Public หรือเจ้าหน้าที่ของกระทรวงการต่างประเทศของผู้ที่ทำเอกสารและเจ้าหน้าที่ผู้ที่มีอำนาจในการรับรองเอกสารในนามของสถานทูตไทย หรือกงสุลไทยในต่างประเทศของผู้ที่ทำเอกสารและผ่านการรับรองจากกระทรวงการต่างประเทศ จึงจะถือว่าเป็นเอกสารที่ถูกต้อง
๓.๓.๒ กรณีเอกสารไม่ผ่าน Notary Public จะต้องดำเนินการเริ่มจากเอกสารใดๆ ที่ทำในต่างประเทศ ซึ่งผู้เสนอราคานำไปแสดงเป็นหลักฐานต่อทางราชการเพื่อประกอบการเสนอราคาการทำสัญญา การแก้ไขสัญญา การขอขยายเวลาทำตามสัญญา การของดหรือลดค่าปรับ หรือการอื่นใดผุ้ที่ทำเอกสารหรือลงลายมือชื่อเอกสารจะต้องเปฎ็นผู้ที่มีอำนาจในการลงลายมือชื่อในเอกสารนั้นในนามของหน่วยงานหรือนิติบุคคลหรือโดยส่วนตัวแล้วกรณี และเอกสารดังกล่าวจะต้องได้รับการตรวจสอบและรับรองจากเจ้าหน้าที่โดยลำดับดังนี้ คือเจ้าหน้าที่ผู้ที่มีอำนาจในการรับรองเอกสารในนามสถานทูต หรือสถานกงสุลต่างประเทศในประเทศไทยและผ่านการรับรองจากกระทรวงการต่างประเทศ จึงจะถือว่าเป็นเอกสารที่ถูกต้อง
