มาตรา 53 แห่ง พระราชบัญญัติคุ้มครองพันธุ์พืช พ.ศ. 2542 กำหนดไว้ว่าผู้ที่ทำการศึกษา ทดลอง หรือวิจัยพันธุ์พืชพื้นเมืองทั่วไป และพันธุ์พืชป่าหรือส่วนหนึ่งส่วนใดของพันธุ์พืชดังกล่าว ที่มิได้มีวัตถุประสงค์เพื่อประโยชน์ในทางการค้า จะต้องแจ้งการศึกษา ทดลอง หรือวิจัย นั้น ๆ ตามระเบียบคณะกรรมการคุ้มครองพันธุ์พืช ว่าด้วยการศึกษา ทดลอง หรือวิจัย พันธุ์พืชพื้นเมืองทั่วไปและพันธุ์พืชป่า ที่มิได้มีวัตถุประสงค์เพื่อประโยชน์ในทางการค้า พ.ศ. 2547
