การขออนุญาตและการออกใบอนุญาต

มาตรา ๑๕ ห้ามมิให้ผู้ใดสั่งเข้ามา นำเข้ามา ผลิต หรือมีซึ่งยุทธภัณฑ์ เว้นแต่จะได้รับใบอนุญาตจากปลัดกระทรวงกลาโหม
การอนุญาตตามวรรคหนึ่ง จะกำหนดเงื่อนไขไว้ในใบอนุญาตก็ได้
การขออนุญาตและการอนุญาต ให้เป็นไปตามหลักเกณฑ์ วิธีการ และเงื่อนไขที่กำหนดในกฎกระทรวง

มาตรา ๑๖ ห้ามมิให้ออกใบอนุญาตตามความในหมวดนี้แก่
(๑) บุคคลซึ่งเคยได้รับโทษจำคุกโดยคำพิพากษาถึงที่สุดให้จำคุกสำหรับความผิดตามประมวลกฎหมายอาญามาตราใดมาตราหนึ่ง ดังต่อไปนี้
(ก) มาตรา ๑๐๗ ถึงมาตรา ๑๒๙ มาตรา ๑๓๘ มาตรา ๑๓๙ มาตรา ๒๐๙ ถึงมาตรา ๒๑๖ มาตรา ๒๘๘ มาตรา ๒๘๙ มาตรา ๓๓๕ ถึงมาตรา ๓๓๗ มาตรา ๓๓๙ ถึงมาตรา ๓๔๐ ตรี
(ข) มาตรา ๒๙๕ ถึงมาตรา ๒๙๘ และพ้นโทษยังไม่เกินห้าปีนับแต่วันพ้นโทษถึงวันยื่นคำขอใบอนุญาต เว้นแต่ในกรณีความผิดที่กระทำด้วยความจำเป็น หรือเพื่อเป็นการป้องกันโดยชอบด้วยกฎหมาย หรือโดยบันดาลโทสะ
(๒) บุคคลซึ่งเคยได้รับโทษจำคุกโดยคำพิพากษาถึงที่สุดให้จำคุกสำหรับความผิดตามพระราชบัญญัติควบคุมยุทธภัณฑ์ พุทธศักราช ๒๔๗๖ หรือพระราชบัญญัตินี้
(๓) บุคคลซึ่งเคยได้รับโทษจำคุกโดยคำพิพากษาถึงที่สุดให้จำคุกตั้งแต่สองครั้งขึ้นไปในระหว่างห้าปีนับย้อนขึ้นไปจากวันยื่นคำขอ สำหรับความผิดอย่างอื่นนอกจากที่บัญญัติไว้ใน (๑) เว้นแต่ความผิดที่ได้กระทำโดยประมาทหรือความผิดลหุโทษ
(๔) บุคคลซึ่งยังไม่บรรลุนิติภาวะ
(๕) บุคคลซึ่งเป็นคนไร้ความสามารถหรือเป็นคนเสมือนไร้ความสามารถหรือเป็นคนวิกลจริต
(๖) บุคคลซึ่งไม่มีอาชีพและรายได้
(๗) บุคคลซึ่งไม่มีที่อยู่เป็นหลักแหล่ง หรือ
(๘) บุคคลซึ่งมีความประพฤติชั่วอย่างร้ายแรงอันอาจกระทบกระเทือนถึงความสงบเรียบร้อยของประชาชน

มาตรา ๑๗ ประเภทของใบอนุญาตมีดังนี้
(๑) ใบอนุญาตสั่งเข้ามา
(๒) ใบอนุญาตนำเข้ามา
(๓) ใบอนุญาตผลิต
(๔) ใบอนุญาตมี
ใบอนุญาตสั่งเข้ามาให้คุ้มกันถึงผู้นำเข้ามาซึ่งยุทธภัณฑ์ตามใบอนุญาตสั่งเข้ามาด้วย
